Terms of service
These terms are an agreement between you and Future Vision Concepts, LLC, a company in the United States ("we" or "us"), which makes Quenote. By using Quenote, its apps, its web app or this website, you agree to them. If you don't agree, please don't use Quenote.
The service
Quenote is a to-do app for iPhone, iPad, Android and the web. The phone and tablet apps are free, and work without an account. Sync, which keeps your tasks up to date across your devices and lets you use the web app, is a paid subscription.
Your account
You need an account, made with your email address, to use Sync and the web app. Anyone who can read your email can sign in as you, so keep your email account secure. You're responsible for what's done with your account, and you should tell us at support@quenote.app if you think someone else has used it. You must be at least 13 years old to use Quenote, and if you're under the age of majority where you live, you need the permission of a parent or guardian.
The Sync subscription
- Price. Sync costs $19.99 a year, plus tax where it applies. You buy it on the web.
- Free trial. Sync starts with a 7-day free trial. If you don't cancel during the trial, your subscription continues, and the first year is charged when the trial ends.
- Renewal. Your subscription renews automatically each year, and we charge your payment method at each renewal until you cancel. If the price changes, we'll tell you before your next renewal, by email or in the web app.
- Cancelling. You can cancel at any time: in the web app, open the Account page and choose Manage billing. Your subscription then runs to the end of the year you've paid for, and doesn't renew. Deleting your account also cancels it.
- Refunds. Except where the law requires otherwise, payments aren't refundable, and we don't refund the unused part of a year.
- Payment. Stripe processes payments for us, through our billing service. You agree to give accurate billing details and to pay the charges for your subscription.
When a subscription ends, Sync stops, and the apps keep working with the tasks on your devices. We delete the copy of your tasks on our servers about 90 days later, as our privacy policy explains.
Acceptable use
Use Quenote only for lawful purposes. Don't:
- use it to break the law or to harm anyone's rights;
- try to get into accounts or data that aren't yours, or get around Quenote's security or limits;
- disrupt or overload the service, or reach it other than through the apps and web app we provide;
- copy, resell or reverse-engineer Quenote, except where the law allows it.
We may suspend an account that's being used in these ways to protect the service and other people.
Your content
The tasks, notes and everything else you put in Quenote are yours. You give us permission to store your content, copy it between your devices and show it to you, only as far as we need to provide Quenote. We don't use it for anything else, and we don't sell it.
Our software
Quenote, its apps, its design and its name belong to us. We give you a personal, non-exclusive and non-transferable right to use them under these terms. If you get an app from the App Store or Google Play, that store's terms apply to it as well.
Availability and beta
We work to keep Quenote running, but we don't promise that it will always be available or free of errors. The phone and tablet apps are in beta: features may change, and problems are more likely than in a finished release. We may change, add or remove features. If we stop offering Sync, we'll tell you in advance, your tasks will stay on your devices, and we'll refund the unused part of any year you've paid for.
No warranty
Quenote is provided "as is" and "as available". As far as the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't warrant that Quenote will be uninterrupted, secure or free of errors, or that your content won't be lost.
Limitation of liability
As far as the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or revenue, that comes from your use of Quenote. Our total liability for any claim about Quenote is limited to the greater of what you paid us for Quenote in the 12 months before the claim, or $20. Some places don't allow these limits, so they may not all apply to you.
Ending these terms
You can stop using Quenote and delete your account at any time. We may suspend or close your account if you seriously or repeatedly break these terms, or if the law requires us to; where we can, we'll tell you first. If we close your account for any other reason, we'll refund the unused part of any year you've paid for. The sections on your content, no warranty, limitation of liability and governing law still apply after these terms end.
Governing law
The laws of the State of [STATE], United States, govern these terms, without regard to its rules on conflicts of law. Any dispute about them goes to the state or federal courts of that state, unless the law where you live gives you the right to bring it elsewhere.
Changes to these terms
We may change these terms. We'll post the new version on this page with a new effective date, and if a change is significant, we'll tell account holders before it takes effect, by email or in the web app. If you keep using Quenote after a change takes effect, you accept the new terms; if you don't accept them, stop using Quenote and delete your account.
